We the following persons being desirous of forming ourselves
into a society under the Societies Registration Act 1860 have actually
subscribed our names to this memorandum. Such declaration needs to be signed by
the 7 or more individuals connected with the society and it should be dated.
Drafting of Rules and Regulations The guidelines and policies of the society
are framed to direct the members of the governing body or the persons entrusted
with the management of the society to manage the functions of the society and
for its internal management. The policies help the management in carrying out
the items of the NGO. They are binding on the members of the society also.
Policies which are irregular with the provisions of the Act are inoperative
although registered with the Registrar of Societies.
A Society is perceived to be an association of persons or a
body of people. A society might be specified as a business or an association of
individuals (typically unincorporated) unified together by shared permission to
mull over, identify and act collectively for same typical purpose. As per the
Societies Registration Act, 1860, (see Annexure 2, VI), a society can be formed
by minimum 7 (or more) individuals, qualified to enter into a contract, for any
of the following purposes:
1.) Grant of Charitable help;
2.) Development of military orphan funds;
3.) Promo of science, literature or the fine arts; direction
and diffusion of beneficial
expertise, diffusion of political education, structure or maintenance
of libraries or checking out spaces for general use of the members or the
general public, public museums and galleries of paintings and other work of
art, collections of nature, mechanical and philosophical inventions,
instruments or designs Besides, the State Governments are equipped to add more
challenge the above list. The primary advantage of forming a society are that
it provides a business look to the organization, and offers greater flexibility
as it is much easier to modify the memorandum and bye-laws of the society that
in case of a trust, terms of which are strictly materialized in the trust deed.
Nevertheless, development of a society requires more procedural procedures than
in case of a trust.
